On 1 August 2017 at 11: 10 the Kyiv Court of Appeal (hereinafter – the Court) will hear the case of the Polish company Coveris Rigid Polska Sp. z.o.o. against Ukrainian raiders.
The address of the Court, where the hearing will take place is 1 Sholudenko Street, Kyiv, case №910/10109/16. The judges hearing the case will be A.N. Baranets, L.H. Sytaylo and S.A.Pashkyna.
Serhii Kryzhov and Elisaveta Gerasymenko, lawyers of Hillmont Partners’s will be representing the interests of Polish Coveris Rigid Polska Sp z.o.o.
Coveris Rigid Polska Sp. Z o.o. is a Polish company and part of the group of the American conglomerate “Coveris” – one of the world’s largest producers of plastic packaging and packaging for dairy products. Its customers include Danon and Lactalis.
More than a year ago Coveris Rigid Polska Sp. Z.o.o. became the victim of illegal actions by new “owners” and officials of LLC “Koveris Rigid Ukraine”. The equipment of the Polish company were seized and there were further attempts to seize its assets through unlawful judgments in the commercial courts of Ukraine.
Because of such illegal actions by the officers of LLC “Koveris Rigid Ukraine”, the investigators of the National Police and the State Fiscal Service of Ukraine have carried out pre-trial investigation in a number of criminal proceedings.
The most disturbing fact is that the judges of the commercial courts of Ukraine during hearing of case No. 910/ 10109/16 admit obvious violations of a significant number of norms of the current legislation of Ukraine, international and Polish law, which benefited the Ukrainian enterprise that took possession of the assets of the Polish company through illegal raiding.
Hillmont Partners will continue to defend the interests of this important Polish investor in the courts and urge the media to observe compliance of the right of a fair trial and high standards of justice in Ukraine.
