Hillmont Partners’ lawyers represent the interests of Polish company in the Economic Court of Kyiv

On Thursday, May 25, the Economic Court of Kyiv (address: 44-B Bogdana Khmelnitskogo St.) will consider the case on the invalidation of contracts between Ukrainian LLC “Coveris Rigid of Ukraine” and the Polish company Coveris Rigid Polska Sp. Z.o.o.

Start time of the court session: 12:30, the judge – Ekaterina Ildarovna Golovina, case number 910/10109/16.

The interests of the Polish side are represented by Hillmont Partners’ lawyers Sergei Kryzhov and Elizaveta Gerasimenko.

The Polish investor considers this case to be fictitious in nature and associates it with the wish to deprive the company of its property rights in Ukraine. A representative of the Embassy of the Republic of Poland in Ukraine will attend the court session.

Company Coveris Rigid Polska Sp. Z.o.o. is a legal entity under the legislation of Poland and is part of the American group, Coveris, one of the world’s largest producers of plastic packaging and packaging for dairy products.

This company is a foreign investor in Ukraine, where it carries out investment activities, including the provision of equipment for leasing to Ukrainian enterprises.

Now Coveris Rigid Polska Sp. Z.o.o. became a victim of illegal actions that contain signs of criminal acts committed by officials and owners of the legal entity of Ukraine – Limited Liability Company “Coveris Rigid Ukraine” (USREOU code 30021648, was registered at 66, Novopirogovskaya St., Kyiv, 03045, now – at the address: 41 Saksaganskogo St., Kyiv).

A number of criminal proceedings is under an investigation by the National Police and the Tax Police due to these actions.

Wrongful actions of LLC “Coveris Rigid Ukraine” consist, among other things, of the seizure of equipment of the Polish company, an attempt by the Raiders to seize assets of Coveris Rigid Polska Sp. Z.o.o. through obtaining unlawful judgments in the courts of Ukraine.

These cases, according to the company, appear to represent support for corporate raiding by the court and judges of the economic courts of Ukraine. The courts, when considering these cases, allow obvious violations of a significant number of provisions under the current legislation of Ukraine, as well as International and Polish law.
