On 5-6 April 2025, Anatolii Voronkin, an Associate of Hillmont Partners‘ White Collar Crime practice, joined the panel of judges for the annual student competition on criminal anticorruption law ‘VII National Anticorruption Moot Court Competition’ organised by ELSA Kyiv.
The European Union and several of its largest economies, including France, Germany, Spain, the Netherlands, and Poland, have withdrawn from the Energy Charter Treaty. They claim the treaty is outdated and incompatible with their climate policies. Despite their exit, the treaty’s twenty-year sunset clause means investors can still bring claims against these states for decades.

Hillmont Partners and Astraea have advised on a settlement between the Stati Parties and the Republic of Kazakhstan in a dispute concerning a 2013 USD 500 million SCC Award, bringing all related litigation to an end.
Hillmont Partners successfully represented a major Ukrainian energy trading company in the LCIA arbitration proceedings in London, securing an award of over USD 3 million under a Sale and Purchase Contract governed by the laws of England and Wales. In addition to the principal sum, the tribunal granted interest at the National Bank of Ukraine (NBU) rate with compound interest accrued on the USD debt, both pre-award and post-award. The full recovery of legal fees and arbitration costs was also awarded.
The Anti-Raider Office of the Ministry of Justice of Ukraine has satisfied the complaint filed by Hillmont Partners on behalf of its client, Madison Pacific Trust Limited. Madison Pacific Trust Limited represents the US lender Argentem Creek. The complaint requested cancellation of an illegal registration action to change the manager of Olympex Coupe International.

A Worldwide Freezing Order (“WFO”) is an interim injunction granted by English courts to restrain individuals or companies from dissipating assets until a judgment can be obtained. WFOs and other foreign interim injunctions are considered as powerful tools in cross-border litigation as they enable the restriction of the transfer of money held in bank accounts, shares, tangible or intangible property in different jurisdictions. In Ukraine, the applicable procedural legislation does not provide for a particular procedure on recognizing and enforcing foreign freezing injunctions, although relevant court practice does shed some light.

The COVID-19 pandemic and the subsequent quarantine have significantly changed the global economic and social landscape. One of the sectors for which mobility restrictions had a very direct and destructive impact was tourism. While most industries were able to find some digital solutions to continue operations during lockdowns, hotels remained almost empty during the spring lockdown in Ukraine, and reported significant falls in occupancy in the following months compared to previous years.
The modern information technology market is developing extremely rapidly. Cryptocurrencies, which are very popular in Ukraine, are no exception. Moreover, according to authoritative publications, Ukraine is among the countries where the use of cryptocurrency is one of the most common in the world.

During 2014-2016, the National Bank of Ukraine (the “NBU“) has carried out the “great bank cleansing” that resulted in the withdrawal of 103 banks from the Ukrainian banking market. Since the assets of some of the insolvent and liquidated banks were insufficient to cover all debts, claims against the banks’ related parties and shareholders whose actions contributed to the insolvency are regularly considered by creditors that have suffered losses. Pursuant to the data published by the Deposit Guarantee Fund of Ukraine (the “DGF“), 49 banks in Ukraine remain in the process of liquidation as of 08 September 2020. Consequently, lawsuits on collection of damages against banks’ related parties may remain an effective mechanism for creditors attempting to recover their losses.

On 6 November 2020, the Ukrainian Parliament registered a Draft Law prepared by the Ministry of Justice and approved by the Cabinet of Ministers, regarding improvement of the corporate and real estate registries’ reliability and security. The Draft Law No 4338 “On Amendments to Certain Laws of Ukraine concerning Regulation of Activities in the Sphere of State Registration of Real Property Rights and Encumbrances and in the Sphere of State Registration of Legal Entities, Individual Entrepreneurs and public formations ” (hereinafter the Draft Law).
The fate of Draft Law No. 2634 of 19.12.2019 has not yet been decided (see the article Collection of VAT from non-residents for provision of electronic services in Ukraine). However, the Verkhovna Rada registered another Draft Law “On Amendments to the Tax Code of Ukraine to Abolish Taxation of Income Received by Non-Residents in the Form of Payment for Production and/or Distribution of Advertising and Improvement of the Taxation Procedure by Value Added Tax of Electronic Services Provided to Individuals by Non-Residents № 4184 of 02.10.2020 (hereinafter – the Draft Law № 4184).

On January 25, 2024, at the extraordinary Congress of the Ukrainian Football Association (UAF), the UAF Board was re-elected and the heads of the football justice bodies were changed.
Hillmont Partners and Astraea Group acted as Global Counsel to Tristan Oil Limited (“Tristan”) for the restructure of US$ 810 million of obligations. The restructure involved a Scheme of Arrangement sanctioned by an order of the British Virgin Islands court on 1 November 2023. Shortly following the BVI order, Tristan filed a petition with the United States Bankruptcy Court for the Southern District of New York (the “SDNY Bankruptcy Court”) seeking entry of an order giving full force and effect to the Scheme within the territorial jurisdiction of the United States. This order was granted on 12 December 2023 despite a last-minute objection filed by the Republic of Kazakhstan (“Kazakhstan”).

One of the key events on the national legal market took place in Kyiv on September 30-October 1, 2021. The Ukrainian Bar Association held its Annual Judicial Forum. Andrii Nyzhnyi, Co-Managing Partner, Head of Dispute Resolution Practice at Hillmont Partners, was one of the forum’s experts and joined the substantive discussion held during the session on ensuring the unity of judicial practice.

Закон № 1381IX про реструктуризацію кредитів, наданих в іноземній валюті, є насамперед соціальним, а не економічним. 23 квітня 2021 року набрав чинності Закон України «Про внесення змін до деяких законодавчих актів України щодо споживчих кредитів, наданих в іноземній валюті» від 13 квітня 2021 року № 1381IX (Закон № 1381IX). Основною метою ухвалення документа є підтримка громадян України, які мають невиконані зобов’язання за кредитними договорами в іноземній валюті (валютними кредитами).

The webinar was held under the auspices of the Association of European Energy Consultants (AEEC), a reputable organization uniting pre-eminent energy law specialists throughout the European Union and beyond.
On March 28, 2021, law of Ukraine no. 1293-IX, amending the Tax Code of Ukraine and law of Ukraine no. 1294-IX, amending the Customs Code of Ukraine (both laws are dated March 2, 2021) came into force. The laws in question are aimed at implementation of another recently adopted law of Ukraine – “On state support of investment projects with significant investments in Ukraine”, providing a framework of state support for investment projects that comply with the list of criteria. Two recently signed laws specify the scope of tax and customs duties exemptions which investors who make significant investments may receive.
On February 27, 2021, Law № 1183-IX on Amendments to the Commercial Code of Ukraine to Eliminate Legal Conflicts in the Requirements to the Charters of Limited and Additional Liability Companies entered into force.

Since then, over 300 joint-stock companies have gone through a squeeze-out procedure, buying out thousands of their minority shareholders.

This article aims at shedding light on the topic of civil liability for causing bankruptcy that is much discussed and in demand nowadays in Ukraine. The application of the legal rules on civil liability is relatively new in this jurisdiction. It started developing only since 2018, when courts began to ‘re-shape’ their approach in deciding such cases.
Ukraine has updated the procedure and, accordingly, the order for holding auctions for sale of special permits for subsoil use.
On 27 October 2020, the Resolution of the Cabinet of Ministers of Ukraine “On Approval of the Procedure for Holding Auctions for Sale of Special Permits for Subsoil Use” entered into force. It replaced the relevant Resolutions of the Cabinet of Ministers of 2011 and 2018, which expired.

It seems fitting after Ukrainian Cossacks Day to recall the legend of one Cossack, Hetman Pavlo Polubotok, who made waves in Ukrainian-British international relations nearly three centuries ago. Legend has it that Pavlo Polubotok, suspecting his arrest under Tsar Peter I of Russia, deposited 200,000 gold coins in the Bank of England in or around 1723 and gifted (most of) them to a future independent Ukraine. With interest that deposit would be worth GBP 40 billion today. The recently signed UK-Ukraine Political, Free Trade and Strategic Partnership Agreement (PFTSPA) is perhaps a first step towards recovering this lost fortune.
On October 14, at the invitation of radio presenter Andrii Kulikov, Tetiana Mylenka, Counsel and Head of the Energy Practice at Hillmont Partners, spoke on radio about the current situation on the green energy market in Ukraine, as well as prospects for foreign investors to submit arbitration claims against Ukraine in connection with the introduction of retrospectively reduced tariffs for electricity generated from renewable energy sources and systemic non-payment / delay in payment for electricity supplied by Guaranteed Buyer.
On 26 August 2020, the National Energy and Utility Regulatory Commission (“NEURC”) finally approved a new methodology for incentive pricing (regulatory asset base regulation) for distribution system operators (“DSOs”). At present, Ukraine uses the cost-plus-tariff setting system for DSOs, which leads to negative consequences for the state of power networks.
The first auctions for the sale of Ukraine’s state-owned distilleries are planned for mid-September 2020, according to a recent Facebook post by Serhiy Bleskun, acting director of the Ukrspyrt State Enterprise. Before July 2020, the state held a monopoly over the ethyl alcohol distilling industry in Ukraine through Ukrspyrt, a fully state-owned company.
