Hillmont Partners supports Scania Ukraine in securing one more landmark win in litigation with another former dealer
The dispute resolution team of Hillmont Partners, acting in a panel of Scania’s defense team, secured a win for their client in a complex commercial dispute with Proskan LLC worth UAH 164.4 million.
Scania Ukraine LLC is the official distributor of Scania, the leading manufacturer of high-capacity vehicles, and one of the largest suppliers of Scania trucks, spare parts and accessories for them.
Proskan LLC, a former dealer of Scania Ukraine LLC, filed several lawsuits against the company asking for damages running into many millions as compensation for lost revenues.
The appellate court ruled in favor of Scania Ukraine, overturning the ruling of the court of first instance and declaring the dealer’s claims to be groundless.
A few months earlier, the Supreme Court had put an end to similar disputes between Scania Ukraine LLC and another former dealer, which, according to the court, also tried to unreasonably collect UAH 123 million from the company in its favor.
The court order is essential both for the automotive industry, which normally operates under the scheme in question, and for the legal community as a whole, given the need to establish legal certainty as to the grounds for recovery of damages in the form of lost revenues.
The Court has demonstrated, by its order, that Ukrainian courts are capable of making objective and consistent decisions, and that foreign investors can always count on adequate protection of their legal rights in Ukrainian courts.
